1. Service Description

J&J Cash Home Buyers ("Company," "we," "us," or "our") is a cash home buying business operated by Jason and Janie Hull in Johnson County, Texas. We purchase residential properties directly from homeowners for cash.

Through our website at jandjcashhomebuyers.com ("Site"), we:

  • Accept property information from homeowners interested in selling
  • Provide no-obligation cash offers based on comparable sales data and property condition
  • Purchase properties using our own funds through a licensed title company
  • Close transactions on a timeline chosen by the seller, typically as fast as 7 days

We are not real estate agents, brokers, or licensed appraisers. We are direct property buyers. No agency relationship is created by use of this Site or by submitting a property inquiry.

2. No Obligation

Submitting your property information through our website or contacting us by phone creates no obligation to sell. Any cash offer we provide is non-binding until a written purchase agreement is signed by both parties. You are free to accept, reject, or ignore any offer at any time.

3. How We Determine Offers

Our cash offers are based on:

  • Recent comparable sales in your area
  • Property condition as described by the homeowner and confirmed by inspection
  • Current local market conditions
  • Estimated repair and holding costs

Our offers are typically below retail market value because we purchase properties as-is, pay all closing costs, and assume all risk of repairs and resale. We encourage all homeowners to consult with a licensed real estate professional or attorney before accepting any offer.

4. Use of the Website

By accessing or using our Site, you agree to these Terms of Service. If you do not agree, you should not use the Site.

You agree that:

We reserve the right to:

  • Decline any property inquiry or withdraw any offer at our sole discretion

5. Information Collection and Privacy

When you submit a property inquiry, we collect your name, phone number and/or email address, and property address with basic condition details. This information is used solely to evaluate your property and contact you regarding a potential offer. We do not sell, rent, or share your personal information with third parties for marketing purposes.

6. No Guarantees or Warranties

The Site and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

We make no guarantee that:

  • We will make an offer on every property submitted
  • Any offer amount will match or exceed the homeowner's expectations
  • A transaction will close within any specific timeframe

7. Limitation of Liability

To the fullest extent permitted by Texas law, J&J Cash Home Buyers, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses arising from your use of or inability to use the Site.

Our total aggregate liability for any claim arising out of or relating to these Terms or the Site shall not exceed the greater of (a) one hundred dollars ($100) or (b) the amount you paid to us in the twelve (12) months preceding the claim.

8. Indemnification

You agree to defend, indemnify, and hold harmless J&J Cash Home Buyers, its owners (Jason and Janie Hull), employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Site, your violation of these Terms, or your submission of false or misleading property information.

9. Dispute Resolution

9a. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

9b. Informal Resolution

Before filing any formal claim, you agree to first contact us at hello@jandjcashhomebuyers.com or (972) 808-6913 to attempt to resolve the dispute informally. We will work in good faith to resolve any issue within thirty (30) days.

9c. Mediation

If informal resolution fails, the parties agree to submit the dispute to non-binding mediation in Johnson County, Texas, before a mutually agreed-upon mediator, before pursuing any other form of dispute resolution. Each party shall bear its own mediation costs, and the mediator's fees shall be shared equally.

9d. Jurisdiction and Venue

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Johnson County, Texas, or the nearest federal court with jurisdiction. Both parties consent to the personal jurisdiction of such courts.

9e. Limitation on Claims

Any claim arising out of or related to these Terms must be filed within one (1) year after the cause of action accrues. Claims filed after this period are permanently barred.

10. Purchase Agreement Terms

These Terms of Service govern your use of our website and initial interactions with us. The actual sale of a property is governed by a separate written Purchase Agreement, which includes the purchase price, closing date, property condition disclosures, contingencies, and signatures of both parties.

No property transaction is binding without a fully executed Purchase Agreement. We recommend all sellers consult with an attorney before signing any purchase agreement.

11. Third-Party Links

Our Site may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or accuracy of any third-party sites.

12. Modifications to These Terms

We may update these Terms at any time by posting a revised version on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any executed Purchase Agreement, constitute the entire agreement between you and J&J Cash Home Buyers regarding use of the Site.

15. Fair Housing Compliance

J&J Cash Home Buyers is committed to the letter and spirit of the federal Fair Housing Act. We provide equal service to all homeowners and do not discriminate on the basis of race, color, religion, sex, handicap, familial status, or national origin.
